Authorize StayBooked to charge your chosen payment method automatically.

Understand that all fees are non-refundable unless otherwise stated in writing.

We reserve the right to suspend or terminate access to Services for overdue accounts.

5. AI Call and Messaging Services

StayBooked’s AI systems may place, record, or respond to calls and messages as part of your workflow. By using these features, you acknowledge and agree that:

You are responsible for obtaining any necessary consent from your customers, contacts, or employees.

You must comply with all TCPA, CAN-SPAM, FTC, and other applicable laws regarding automated communication.

StayBooked is not responsible for any legal claims resulting from your misuse of AI or automation tools.

6. Data Usage and Privacy

We collect and process data in accordance with our Privacy Policy. By using our Services, you grant StayBooked a license to use anonymized or aggregated data for analytics, service improvement, and product enhancement.

We do not sell customer data or personal information.

7. Third-Party Integrations

Our platform may integrate with third-party software (e.g., GoHighLevel, Twilio, Calendly, Facebook). You acknowledge that:

Third-party platforms are governed by their own terms and policies.

StayBooked is not responsible for third-party outages, errors, or data breaches.

8. Intellectual Property

All StayBooked software, trademarks, logos, content, and technology remain the exclusive property of StayBooked LLC. You may not copy, resell, or reverse-engineer any part of our Services.

You retain ownership of all data and content you provide to the platform.

9. Prohibited Uses

You agree not to use the Services for:

Spamming, harassing, or misleading communications.

Sending unlawful or deceptive content.

Violating data privacy or telecommunication laws.

Violation may result in suspension or termination of your account without refund.

10. Limitation of Liability

Our total liability shall not exceed the total amount paid to StayBooked in the past 12 months preceding the claim.

You agree to indemnify and hold harmless StayBooked LLC, its officers, employees, and affiliates from any claims, damages, or expenses (including attorney fees) arising from your use of the Services or violation of these Terms.

12. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of our Services at any time, with or without notice. We may also update these Terms, and continued use constitutes acceptance of any changes.

13. Termination

Either party may terminate the agreement at any time. Upon termination:

You must cease all use of the Services.

Outstanding fees remain due immediately.

Sections regarding payment, liability, and intellectual property will survive termination.

14. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes will be resolved in Maricopa County, Arizona.
